TEXT ORDER denying Plaintiff's Motion for Reconsideration pursuant to Federal Rule of Civil Procedure 59(e). (Doc. 37). The Court dismissed Plaintiff's Complaint as a shotgun pleading with leave to amend on two separate opportunities (Docs. 21, 31). In the second order, the Court explained that the Complaint's claims adopted the allegations of preceding counts. (Doc. 31) (citing Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1321-23 (11th Cir. 2015)). The Court provided leave to amend and warned Plaintiff that "[a] pro se plaintiff must be given at least one chance to amend the complaint before the district court dismisses the action with prejudice." (Id.) (quoting Silberman v. Miami Dade Transit, 927 F.3d 1123, 1132 (11th Cir. 2019)). Plaintiff filed its Second Amended Complaint shortly thereafter. (Doc. 32). The Court again found that the Second Amended Complaint was still a shotgun pleading, explaining that because the Court had "already provided Plaintiff with two opportunities to amend his complaint," the Complaint was dismissed without leave to amend and therefore closed the case. (Doc. 33). Accordingly, the Motion for Reconsideration (Doc. 37) is DENIED. Signed by Judge John L. Badalamenti on 10/2/2026. (YSR)
