ORDER granting 6 Motion to Dismiss for Failure to State a Claim; denying 20 Motion for Leave to Amend. Scurry County's motion to dismiss (Dkt. No. 6) is granted, Aviles's motion for leave to amend (Dkt. No. 20) is denied, and the claims against Scurry County are dismissed with prejudice. In view of Aviles's threadbare allegations against Scurry County, the Court grants Scurry County's motion (Dkt. No. 6) and dismisses Aviles's claims against Scurry County with prejudice. Further, because it is not a jural entity, the Court dismisses all claims against the Scurry County Jail with prejudice. Finally, the Court will give Aviles 21 days to respond to this Order before dismissing his claims against the City of Snyder with prejudice sua sponte.
