   Order on Motion to Consolidate Cases Order on Motion for Extension of Time to File

   ORDER: The Appellants have now filed three motions for extensions of time. The Court has already granted two extensions, and the new application seeks a new kind of relief. Previously, the requests were for an extension of time to file an opening brief, and now the request is to file a new briefing schedule—not a brief. Besides engaging in a kind of bait-and-switch, this motion attempts to force the Court to advance its decision on a pending motion to relate cases and consolidate appeals. As to that issue, the motion to consolidate 6 is denied. The parties mix up the concept of related cases designation—while citing an out-of-date set of rules regarding such designations—and the concept of consolidation. (One involves the cases being decided by the same judge; another involves a single judgment resolving both appeals; and there are a number of possible alternatives, intermediate options in-between, including filing a single brief to cover all issues in both cases, but having them being decided separately.) And their cursory description of common issues fails to explain why two separate appeals should be consolidated into a single matter or how they propose to do so—the letters each propose slightly different options—and fails to address the relevant law regarding consolidation. The Court will undertake a review to determine whether the cases should be assigned to the same judge under the current Division of Business Rules. The parties should proceed to file separate briefs in each appeal. If the cases indeed involve the same or similar questions of law and fact as the parties insist, nothing precludes the parties from filing nearly identical briefs in both cases, or incorporating their briefs filed in the other case by reference. The motion for extension of time to file the opening brief 7 is extended to September 23, 2026. All other requests are denied. So ordered by Judge Sanket J. Bulsara on 9/10/2026. (BEM)
