Minute entry for proceedings held before Magistrate Judge Diana Song Quiroga. Status Conference held on August 14, 2026. Petitioner appeared via Zoom through counsel Kaitlin Kline and Taylor Cavaliere Jones and Respondents appeared via Zoom through counsel Hilda Garcia Concepcion. This case arises from a 2241 immigration habeas petition. Petitioner had previously been detained, her removal was withheld, and she was later granted asylum. The Court asked for a status update on whether Respondents were planning to remove Petitioner to a third country. Ms. Garcia Concepcion explained that everything had been teed up. After Petitioner had been granted asylum on August 2, 2026, Respondents counsel reached out to DHS who confirmed that it was not going to pursue an appeal of Petitioners grant of asylum. Subsequently, both parties agreed to file a joint motion to the extend the TRO until the end of the asylum appeal period, September 2, 2026. The Court inquired about Petitioners current status, and both parties confirmed that Petitioner was on supervised release, subject to DHS reporting obligations. The Court confirmed that after the TRO expires, assuming no appeal has been taken, the Petitioner has agreed to withdraw her request for a preliminary injunction.At the hearing, counsel for Petitioner agreed to file a Motion to Dismiss on September 3, 2026 (the day after the TRO expires). The Court also instructed counsel for Respondents to confirm that Petitioner will not be in jeopardy of removal and for the parties to update the Court on the post-TRO conditions for Petitioner to stay in the country.
