ORDER : The Court cannot both find that the voluntary dismissal "was not the product of a settlement of Plaintiff's FLSA claims," Dkt. 18, and "accept the settlement between the parties," Dkt. 18-1 paragraph 13. Accordingly, by October 7, 2026, the parties shall submit a letter advising the Court of their respective positions on (1) whether they seek approval of the settlement agreement under Cheeks; and (2) whether the parties are prepared to stipulate to a voluntary dismissal subject to an order that the settlement agreement is invalid to the extent it releases Plaintiffs FLSA claims. Order on Motion for Pre Motion Conference
ORDER: The Court has reviewed the parties' pre-motion letters regarding Defendant's proposed motion for summary judgment and accompanying statements of material facts. See ECF Nos. 33 , 34 , 35 , 36 . The Court finds that a pre-motion conference is unnecessary. Defendant shall file its papers in support of the motion for summary judgment on or before October 26, 2026. Plaintiff shall file her opposition papers on or before November 26, 2026. Defendant's reply papers, if any, shall be filed on or before December 9, 2026. The parties are directed to review Section IV.B. of this Court's Individual Practices.
