The Court makes preliminary remarks and hears representations of counsel. For the reasons stated on the record at today's hearing, IT IS ORDERED THAT:
The Defendant Align Companies LLCs Motion to Dismiss 46 is GRANTED for want of personal jurisdiction. The clerk of court is directed to terminate Align as a defendant. The Defendants Conti and Rodriguezs Motion to Dismiss 47 is GRANTED in part and DENIED in part. Amended Complaint with limited leave due 8/19/2026.
The First Cause of Action, Misappropriation of Trade Secrets against Conti and Rodriguez is DENIED. The Third Cause of Action, Breach of the Implied Covenant of Good Faith and Fair Dealing against Conti and Rodriguez is DENIED.
The Fourth Cause of Action, Unjust Enrichment against All Defendants is DENIED.
The Fifth Cause of Action, Conversion against All Defendants is GRANTED without prejudice and without leave to amend.
The Sixth Cause of Action, Injunctive Relief against All Defendants GRANTED without prejudice and with leave to amend.
The Seventh Cause of Action, Specific Performance against Conti and Rodriguez is GRANTED without prejudice and with leave to amend.
The Eight Cause of Action, Civil Conspiracy against All Defendants is DENIED.
The Twelfth Cause of Action, Declaratory Relief against Conti and Rodriguez is GRANTED without prejudice and with leave to amend.
The Motion to Modify Preliminary Injunction 52 is DENIED as moot.
The Motion for Order to Show Cause 53 is GRANTED.
Defendants Victoria Conti and Debra Rodriguez are ordered to appear in person with counsel and show cause why they should not be held in contempt of court on September 10, 2026, at 10:00 AM in LV Courtroom 6D before Judge Jennifer A. Dorsey.
