ORDER. In sua sponte continuing the status conference, ECF No. 292, the Court neglected to consider the "unavailab[ility]" of counsel during "the weeks of July 6 and 13 due to a federal trial," Plaintiffs' Response to Defendants' Motion for Status Conference at 3, ECF No. 288, and having further considered the matter, the status conference scheduled for July 8, 2026 at 10:00 a.m. will now be CANCELLED.
As to the pending motions before U.S. Magistrate Judge Thomas O. Farrish—the Plaintiffs' Motion for Attorneys' Fees and Costs Associated with Plaintiffs' Second Sanctions Motion, and Defendants' Motion for Relief from Expert Deadlines—those motions remain before Judge Farrish and will be addressed by him.
As to the pending motions in limine, ECF Nos. 257, 259, 261, 262, those motions will be addressed at or before the final pretrial conference. See Court's Trial Preferences (noting that motions in limine are usually addressed "at pretrial conferences or at oral argument before trial").
As to the pending motion for a supplemental notice plan, ECF No. 285, the briefing with respect to it is not yet fully submitted, see Order, ECF No. 286, (providing until July 17, 2026 for a reply brief), and will be addressed not too long after it has been.
As to the pending motion for a trial plan, giving the various filings already submitted by the parties, see ECF Nos. 242, 255, and 268, as well as the Joint Trial Memorandum and subsequent submissions, see ECF Nos. 265 and 271, the Court intends to address these issues in the immediate future, likely in conjunction with the pending motion for a supplemental notice plan. But, upon further consideration (and given the extensive briefing), a status conference discussing these matters now would not be sufficiently productive.
