PAPERLESS ORDER Granting 11 Agreed Motion for Extension of Time to File Answer Brief. Appellee's Answer Brief due by 9/29/2026. As Appellee's motion states, "[a] timely motion to extend is reviewed for good cause, not excusable neglect... and should be liberally granted absent a showing of bad faith... or undue prejudice." Lizarazo v. Rudolph R. Reindeer, et al., 878 F.3d 1008, 1012 (11th Cir. 2017). In this case, the alleged good cause is presumably "Appellee's counsel's other case commitments." It is unlikely "those other case commitments" arose for the first time today, the day before the deadline to file the answer brief.
