Summary Judgment Leave to File Document Under Seal
MINUTES (IN CHAMBERS) by Judge Otis D. Wright, II: On October 8, 2026, Plaintiff and Defendant each filed a number of documents, many in error and the rest attempting to correct those errors. (Dkt. Nos. 6776.) With respect to those filings, the Court ORDERS as follows: Plaintiffs filings at Docket Nos. 67, 68, and 69 are WITHDRAWN, pursuant to Plaintiffs Notice of Withdrawal. (Dkt. No. 73.) Plaintiff's Motion for Judgment as a Matter of Law, filed at Docket No. 70, remains operative. With respect to Plaintiff's Application to file document under seal, (Dkt. Nos. 7172), Plaintiff does not satisfy Local Rule 79-5.2.2. See C.D. Cal. L.R. 79.5-2-2(b) ("[T]he Filing Party['s] supporting declaration must identify the material previously designated as confidential, as well as the Designating Party, and must describe in detail the efforts made to resolve the issue.) Setting aside that failure, it appears that Defendant is the party designating the document as confidential. (See Decl. Glenn. R. Kantor 2, Dkt. No. 72.) As such, within four (4) days, Defendant must file a declaration supporting the request to file under seal. C.D. Cal. L.R. 79.5-2-2(b)(i). Failure to do so will result in the application to seal being denied.Defendants filing at Docket No. 74 is WITHDRAWN, pursuant to "Defendants Notice of Errata and Withdrawal and Replacement." (Dkt. No. 76.) Defendant's Motion for Judgment as a Matter of Law, filed at Docket No. 75, remains operative. Once briefing is complete, the Court will determine whether oral argument is necessary. The parties are advised that the Court will not clean up their erroneous filings in the future. It will simply strike the filings and require the parties to refile correctly. (lc)
