MINUTE entry before the Honorable Daniel P. McLaughlin: Non-Party Shannon McQuarter's Motion to Quash or Modify Subpoenas 469 is granted. Ms. McQuarter's motion concerns a document subpoena issued to her by Defendants David Hudspeth, David Heppner, Luby Novitovic, and Terry Hillard. The subpoena commands Ms. McQuarter -- an eyewitness -- to produce eight categories of documents. The Court, in its discretion, quashes the subpoena because it has determined that: (1) Subpoena Requests Nos. 1 and 4 seek documents that are more appropriately obtained from Plaintiffs; (2) Subpoena Requests Nos. 2, 5, and 8 seek documents that would more appropriately be sought via subpoenas to the government and identified law firms; and (3) Subpoena Requests Nos. 3, 6, and 7 involve topics that would more appropriately be explored as an initial matter via a deposition of Ms. McQuarter.
