TEXT ORDER-- The Court has reviewed the respective requests filed by Plaintiff and Defendant Thomas Brophy (ECF Nos. 21 , 22 ) to permit the clients to appear virtually for the in-person initial scheduling conference set for July 16, 2026 (ECF No. 20), and the response by Defendant National Publisher Servicers, LLC ("NPS") (ECF No. 23 ). Defendant Brophy's request is granted, as he did not choose to proceed in this Court. Brophy shall appear virtually on a device provided by counsel (who shall attend in-person), and he shall be present and remain visible on camera for the entirety of the conference. Plaintiff's request is DENIED. First, Plaintiff chose to proceed in this Court. The fact that this case has been deemed related to a separate case involving NPS by the Clerk of the Court, based on Plaintiff's own requests in the civil cover sheet (ECF No. 1 -1) and separate correspondence filed on April 10, 2026 (ECF No. 2 ), is merely administrative in nature and without any dispositive force. Second, based on NPS's arguments raised in support of its motion to transfer the case to federal court in Arizona (ECF No. 7 ), it appears that NPS is not challenging personal jurisdiction in Arizona. Therefore, although Plaintiff's request is denied, it is denied without prejudice to the filing by July 1, 2026 of a stipulation signed by all parties consenting to the Arizona federal court's jurisdiction and to transfer the case there.
