Stipulation and Order of Voluntary Dismissal
JOINT STIPULATION OF DISMISSAL: IT IS HEREBY STIPULATED AND AGREED between the parties as follows: 1. This action is hereby voluntarily dismissed pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), without prejudice and without costs or fees to any party. 2. Within 14 days of the filing of this Stipulation of Dismissal, USCIS shall produce to Plaintiff the Form I-130, Petition for Alien Relative, for the Previous I-130 Petition, along with photographs and the marriage certificate submitted in connection with the Previous I-130 Petition. 3. Within 45 days of the filing of the executed Stipulation of Dismissal, USCIS shall both reopen the September 2, 2022, I-130 Petition and take further adjudicative action, such as scheduling an interview or issuing a request for evidence or other notice, as USCIS deems appropriate. 4. The parties join this Stipulation of Dismissal in the interest of preserving party and judicial resources and expediting the resolution of this case, and Plaintiff thereby acknowledges no guarantee as to any completion date or decision in adjudication of the September 2, 2022, I-130 Petition, except as indicated herein. USCIS will endeavor to adjudicate the September 2, 2022, I-130 Petition within a reasonable time frame of Plaintiff's response to any issued notice and/or interview 5. This Stipulation of Dismissal contains the entire agreement between the parties, and no statement, representation, promise, or agreement, oral or otherwise, between the parties or their counsel that is not included herein shall have any force or effect. 6.
