Order on Motion for Protective Order
ORDER adopting parties' stipulated protocol for the collection and production of electronically store information, ECF No. 28 -1; stipulation and order regarding claw-back agreement, ECF No. 29 -1; and confidentiality stipulation and protective order, ECF No. 26 -1, subject to the following modifications to the protective order:
The following sentence is added to the end of Paragraph 4: "If confidential information is subpoenaed, the recipient of the subpoena shall furnish to opposing counsel a copy of the subpoena, or will notify opposing counsel of the subpoena, if permitted by law."
The following sentence is added to the end of Paragraph 11: "The parties will raise any such disputes in accordance with the Local Rules and the Individual Judges' Rules."
The following sentence is added to the end of Paragraph 14: "The Court's rules include the Local Rules and the Individual Judges' Rules."
The following sentence is added to the end of Paragraph 16: "All issues related to the use of confidential information at trial shall be decided by the trial judge."
The following sentence is added to the end of Paragraph 18: "Counsel may retain one complete set of materials produced in the case, and any working documents reflecting such materials."
The following sentence is added as Paragraph 24: "The restrictions and obligations imposed by this Protective Order do not apply to the Court and its staff."
