Order ~Util - Set/Reset Hearings
TEXT ORDER: Attorneys Michael D. Lee, Katherine G. Rosendale, and the firm Kelleher & Holland, LLC 24 move to withdraw as counsel for Defendants, explaining that a breakdown in communications and irreconcilable differences leave them unable to continue their representation. Granting that motion, however, would leave Defendants (three corporations and one individual) unrepresented. But corporations are not permitted to litigate in federal court pro se. Additionally, the Court requires confirmation of Defendant Thomas Pettigrew's understanding of his rights and obligations, including that he may proceed pro se if new counsel does not appear and that he must comply with all rules, deadlines, and obligations regardless of representation. Accordingly, the Court SETS the 24 motion for a hearing on September 30, 2026, at 11:00 A.M. by telephone before Magistrate Judge Ronald L. Hanna. Defendant Thomas Pettigrew and an authorized representative of each corporate Defendant shall personally participate in the hearing. The parties shall dial 551-285-1373 and enter Meeting ID: 16095893703# when prompted. Attorneys Lee and Rosendale shall provide Defendants with a copy of this Order and file a certificate of service confirming such notice. The Court also notes that under Civil Local Rule 11.4(A)(2), "[d]ocuments signed by an attorney must be filed using that attorney's log-in and password; they may not be filed using a log-in and password belonging to another attorney." This 24 motion appears to violate that requirement. The parties are advised that future filings that do not comply with Rule 11.4(A)(2) may be stricken. Entered by Magistrate Judge Ronald L.
