REPORT AND RECOMMENDATION: Pending before the Court is Defendants PHH Mortgage Corporation ("PHH") and Western Progressive-Tennessee Inc.'s ("Western Progressive" and, collectively, "the Defendants") motion to dismiss this action filed by pro se Plaintiffs Roland Hayes Streeter, Sr. and Sharron Ann Wood Streeter (collectively, "the Streeters"). (Doc. No. 7 ). For the foregoing reasons, the Magistrate Judge RECOMMENDS Defendants PHH Mortgage Corporation and Western Progressive-Tennessee, Inc.'s motion to dismiss (Doc. No. 7 ) this action be GRANTED IN PART AND DENIED IN PART by GRANTING the motion to dismiss (Doc. No. 7 ) in its entirety as to Western Progressive-Tennessee, Inc. and DISMISSING Counts 1 through 15; GRANTING IN PART the motion to dismiss (Doc. No. 7 ) as to PHH Mortgage Corporation and DISMISSING Counts 1 through 7 and Counts 9 through 15; DENYING IN PART the motion to dismiss (Doc. No. 7 ) as to Count 8 (Negligent Misrepresentation) as to PHH Mortgage Corporation.
