Order on Motion for Leave to File
ORDER by District Judge Margaret I. Strickland GRANTING 5 Defendants' Opposed Motion for Leave to File Amended Notice of Removal and Substitute Exhibit to the Notice of Removal. Upon review of the 5 Motion, 9 Response, 14 Reply, and the record, the Court deems Defendants' request to amend their Notice of Removal to correct a factual error regarding the type of degree Defendant Caraveo holds to be unopposed. The Court further finds that Defendants' request to withdraw Exhibit 2 and replace it with a redacted version with the Amended Notice of Removal is well-taken, as the proposed redaction is narrowly tailored, concerns the safety and security of staff and inmates, is irrelevant to Plaintiff's Motion to Remand, ECF No. 7 , and does not otherwise prejudice Plaintiff. The Court will Order the Clerk's Office to seal all of the Exhibits attached to the original Notice of Removal because they are all contained in a single filing, ECF No. 1-1, and Defendants shall refile all of the Exhibits as an attachment (or multiple attachments) to the Amended Notice of Removal, with Exhibit 2 redacted.
Accordingly, it is HEREBY ORDERED that Defendants' Opposed Motion for Leave to File Amended Notice of Removal and Substitute Exhibit to the Notice of Removal, ECF No. 5 , is GRANTED; Defendants shall have until and including September 16, 2026 to refile the Amended Notice of Removal and Exhibits, with the redacted Exhibit 2, as separate entries on the docket; and the Clerk's Office SHALL seal the Exhibits to the original Notice of Removal, ECF No. 1-1.
