Order on Motion to Dismiss for Failure to State a Claim Order on Motion to Consolidate Cases
MEMORANDUM ORDER- For the sake of judicial economy, pursuant to Federal Rule of Civil Procedure 42(a), the Court GRANTS the Motions to Consolidate (ECF No. 65, 974 case; ECF No. 50, 981 case; ECF No. 46 , 982 case; ECF No. 42, 983 case; and ECF No. 48, 984 case) and DIRECTS the Clerk to consolidate the above-captioned cases for pretrial issues only. The Court ESTABLISHES Civil Action No. 3:25CV974 as the lead case (hereafter, the Consolidated Action). All papers filed with respect to the Consolidated Action shall be filed in Case No. 3:25CV974 ONLY and shall bear the case caption reflected on this Order. Accordingly, the Court GRANTS the Motion to Stay (ECF No. 62) and ORDERS that, across the Consolidated Action, all pretrial deadlines are hereby STAYED pending the United States Patent and Trade Offices reexaminations of the patents at issue. The Court ORDERS Perrone to file a status report in the Consolidated Action on or before March 1, 2027, regarding the status of the PTO reexaminations. In light of the consolidation of these related actions, the PTOs reexamination of the underlying patents, and the stay resultingly imposed in this Order, the Court DENIES WITHOUT PREJUDICE all pending Motions to Dismiss and related Motions.
