TEXT ORDER: The Court has reviewed Defendants' pre-motion letter seeking leave to move for partial dismissal of the First Amended Complaint and Plaintiffs' response. D.Es. 9 & 11 . Among other claims, Plaintiffs allege in Count IV that Defendants conspired, in violation of 42 U.S.C. § 1985(3), to remove Plaintiffs from their elected party positions based on their political beliefs and disagreement over which candidates to support. Third Circuit precedent appears to foreclose that claim. In Farber v. City of Paterson, 440 F.3d 131, 142-43 (3d Cir. 2006), the Third Circuit held that § 1985(3) does not provide a cause of action for injuries caused by conspiracies motivated by discriminatory animus based on political affiliation. Count V, brought under 42 U.S.C. § 1986, likewise appears foreclosed because liability under § 1986 depends upon a preexisting violation of § 1985. Clark v. Clabaugh, 20 F.3d 1290, 1295 (3d Cir. 1994). In light of this authority, the Court ORDERS the parties to meet and confer in good faith as to whether the parties can otherwise narrow the issues presented by Defendants' anticipated motion and/or potentially avoid motion practice. Within 14 days of this Order, the parties shall file a joint letter updating the Court on the status of those discussions and advising how they propose to proceed.
