ORDER: The undersigned has been advised by Plaintiff's counsel that the parties reached a resolution and agreed to sell the farm property at issue, and the sale is set for closing on April 26, 2024. Accordingly, within 30 days of the closing -- or by May 28, 2024 -- Plaintiff shall file a motion to voluntarily dismiss this case in accordance with Federal Rule of Civil Procedure 41(a)(2)(A)(ii) (or the parties can file a joint stipulation of dismissal in accordance with Federal Rule of Civil Procedure 41(a)(1)(A)(ii)). If the sale does not close on April 26, 2024 as expected, and the parties require more time to fully resolve matters, Plaintiff may file a motion for an extension of time to voluntarily dismiss the case. Due to the impending sale, the Court DENIES AS MOOT all pending motions, CANCELS all settings, and VACATES all deadlines and hearings in this case. Signed by Magistrate Judge Mark A. ORDER: This matter is before the Court sua sponte for case management purposes. Defendant Corey McDonald filed his answer to the complaint (Doc. 72). Defendant Scott McDonald did not (see Doc. 70). Per the Court's previous Order, Plaintiff is expected to move for a Clerk's entry of default as to Scott McDonald pursuant to Fed. R. Civ. P. 55(a). By April 18, 2024, Plaintiff must file either a motion for an entry of default as to Scott McDonald or a status report explaining why he is opting not to pursue default at this time. The Clerk of Court is DIRECTED to add the address and email address for Scott McDonald that was provided in Doc. 71 to the docket. Finally, this case is set for a status conference on 5/2/2024 at 11:00 AM before Magistrate Judge Mark A. Beatty via ZOOM. The parties will receive a ZOOM invitation via email from the Court.
