PRE-TRIAL SCHEDULING ORDER: A pre-trial conference was last held in this matter on June 16, 2020. The Court hereby makes the following provisions for scheduling and trial in this matter. Other motions, including but not limited to motions in limine relating to evidentiary issues, must be filed and served no later than thirty (30) days before the date set forth in paragraph 7 below, unless otherwise allowed by the Court for good cause shown. In a case to be tried before a jury, and no later than seven (7) days before the Final Pre-Trial Conference date set forth in paragraph 7 below: The parties are directed to appear before the undersigned in Courtroom No. 17C, 500 Pearl Street, New York, NY 10007, for a final pre-trial conference on Friday, February 19, 2027, at 11:00 a.m. The purpose of the conference is to explore the possibility of settlement, to schedule the trial (which shall, the Court's calendar permitting, commence within two weeks after the conference) if necessary, to review the issues to be tried and the proof to be offered in connection therewith, and to resolve any remaining pre-trial issues. As further set forth within this Order. Final Pretrial Conference set for 2/19/2027 at 11:00 AM in Courtroom 17C, 500 Pearl Street, New York, NY 10007 before Judge Laura Taylor Swain. MEMORANDUM OPINION AND ORDER re: 111 FIRST MOTION for Summary Judgment . filed by Matthew Gross, Newsela, Inc..For the reasons explained above, Defendants' motion for summary judgment is granted in part and denied in part. The mo tion is granted as to Plaintiff's claim that Defendants failed to accommodate her third, fourth, fifth, sixth, and seventh accommodation requests (Counts 2, 4, and 6); as to Plaintiff's claim that Defendants failed to engage in an interacti ve process under the ADA and NYHSRL (Counts 2, 4, and 6); and as to Plaintiff's retaliatory OSTENFELD MSJ SEPTEMBER 15, 2026 38 hostile work environment claim under the FMLA (Count 1). The motion is denied with respect to all of Plaintiff' s other claims. Docket Entry No. 111 is resolved. A Final Pretrial Conference is hereby scheduled for Friday, February 19, 2027, and the parties are directed to consult, exchange documents and make submissions in accordance with the Pretrial Scheduli ng Order filed contemporaneously herewith. The parties are further directed to arrange promptly for a settlement conference with Magistrate Judge Wang, to whom this case will be referred for that purpose, and to file a joint status report, including their estimate of the amount of time that will be required for any contemplated trial, by Tuesday, December 21, 2026.
