MINUTE ORDER This case is before the Court on review of the docket and Judge Brimmer's Order dated August 19, 2026 (ECF No. 345 ). In that Order, Judge Brimmer noted that the Court had not ruled on the entirety of Non-Party City of Longmont, Colorado's ("Longmont") Emergency Motion for Protective Order/Motion to Quash ("Motion to Quash") (ECF No. 211 ). Instead, the Court stated that no party was required to make disclosures in response to the subpoenas at issue until a final determination was made on the Motion to Quash (see ECF 219 ). Now, for the reasons stated in the Court's Report and Recommendation (ECF No. 273 ) and subsequent Minute Order (ECF No. 275 ), it is hereby ORDERED that the Motion to Quash (ECF No. 211 ) is GRANTED. Specifically, the Court finds that, pursuant to Rule 45(d)(3) and Rule 26(b)(1) and (b)(2)(C), the materials sought by Plaintiff are not proportionate to the needs of this case, which involves a single claim for malicious prosecution, and fall outside the scope of this litigation.
