Order on Motion for Order
ORDER denying without prejudice plaintiffs' 42 Motion for Order of Compliance. In their motion, the plaintiffs request "an order compelling the defendant Americredit Financial Services, Inc. to comply with their Interrogatories and Requests for Production of Documents dated February 12, 2026." Local Rule 37(a) requires a plaintiff who brings a motion pursuant to Fed. R. Civ. P. 37 to file an affidavit that certifies that the plaintiff has met and conferred with the defendant regarding the issues raised by the motion prior to seeking court intervention. Local Rule 37(a) also requires a plaintiff to file a memorandum that "contain[s] a concise statement of the nature of the case and a specific verbatim listing of each of the items of discovery sought or opposed[.]" The plaintiffs have not submitted an affidavit detailing whether the parties have met and conferred prior to the filing of the motion or a memorandum outlining the exact documents that the plaintiffs want the defendants to turn over. They have therefore not complied with Local Rule 37(a). Accordingly, I deny without prejudice the plaintiffs' 42 Motion for Order of Compliance. If they wish to renew their motion, the plaintiffs must comply with Local Rule 37(a). Signed by Judge Stefan R. Underhill on 6/24/2026. (SK)
