ORDER denying 129 the defendants' motion for summary judgment without prejudice to renewal. The plaintiff seeks to amend his Rule 56.1 counterstatement. (See ECF No. 136 at 2.) Accordingly, 129 the defendants' motion for summary judgment is DENIED without prejudice to renewal. The defendants may refile their motion for summary judgment. Before any party moves for summary judgment, the parties must comply with the Court's Individual Practices and Rules, including requesting a pre-motion conference. Accordingly, the defendants will amend their Rule 56.1 statement, if necessary, and serve it on the plaintiff by July 2, 2026. The plaintiff will amend his Rule 56.1 counterstatement and serve it on the defendants by July 23, 2026. The defendants will file their pre-motion conference letter and their Rule 56.1 statement, with the plaintiff's counterstatement, by July 30, 2026.
