Order
FINDINGS OF FACT AND CONCLUSIONS OF LAW: For the reasons stated above, the Court GRANTS the Petition, finding that Mr. Mudge has established a prima facie case of wrongful removal and that repatriation of B.M. to Mexico would not expose him to a grave risk of harm. The child is ORDERED returned to Mexico on or before August 7, 2026. The parties are directed to meet and confer and, to the extent possible, come to an agreement as to the proposed travel details. In addition, pursuant to 22 U .S.C. § 9007, Ms. Gamble is ORDERED to pay the necessary expenses incurred by Mr. Mudge during this proceeding, including legal fees and costs. The parties are ORDERED to meet and confer and determine whether they can agree upon a figure for the fees and costs, and thereby stave off additional litigation that would warrant "fees on fees." If the parties are unable to resolve the issue of fees and costs on or before August 7, 2026, they are directed to submit a joint letter o n that date proposing a briefing schedule for the Court's consideration. The Clerk of Court is directed to terminate the pending motion at docket entry 3. SO ORDERED. Motions terminated: 3 FIRST MOTION to Expedite RETURN OF CHILD. filed by Damien Scott Mudge. (Signed by Judge Katherine Polk Failla on 7/8/2026) (jca)
