Status Conference ~Util - Set Hearings
Minute Entry and Order: A telephonic Pre-Settlement Status Conference was held on 8/11/2026 before Magistrate Judge Taryn A. Merkl. Appearances by Paul Liggieri for Plaintiff and Cynthia Ann Lee for Defendants. Discussion held regarding case status and the history of the settlement negotiations to date. As discussed on the record, by 9/14/2026, Defendants are respectfully directed to provide a formal offer in response Plaintiff's demand. The parties are also respectfully directed to continue to meet and confer and to exchange the discovery and evidence that is pertinent to settlement by 9/30/2026 to ensure a productive settlement conference, and to engage in further settlement negotiations in advance of the anticipated settlement conference.
At the parties' request, an initial Settlement Conference will be held in person on 10/21/2026 at 2:30 p.m. in Courtroom 13 D South before Magistrate Judge Taryn A. Merkl. Plaintiff is directed to appear personally with counsel; a representative for the Office of the New York City Comptroller with full settlement authority is directed to be available via phone for the duration of the settlement conference. In advance of the conference, the parties are directed to submit their respective ex parte settlement positions via Chambers email, merkl_chambers@nyed.uscourts.gov, no later than the close of business on 10/13/2026. The statements must include a history of the settlement negotiations to date (including the last offer and demand), and a frank assessment of the strengths and weaknesses of each party's case. The Court may schedule ex parte telephone calls with counsel after review of the statements. The parties are also directed to make any arrangements for interpreters, if needed, to facilitate the settlement conference. In advance of the settlement conference, the parties are directed to exchange all discovery necessary for a reasoned consideration of settlement.
Further discussion held regarding the current discovery schedule. The following deadlines are extended, on consent. Fact discovery shall be completed on or before 11/13/2026. The parties are directed to file a joint status report certifying the close of fact discovery by 11/27/2026. Exchange of expert disclosures shall be completed by 12/14/2026. Expert depositions shall be completed by 1/26/2027. Exchange of rebuttal expert reports shall be completed by 3/12/2027. All expert discovery shall be completed by 4/12/2027, and certification of the completion of all discovery shall be filed on ECF by 4/26/2027. The last date to take the first step in dispositive motion practice is 5/26/2027, and must be done in accordance with the Individual Rules of the assigned District Judge.
