ELECTRONIC ORDER:
The Court previously denied Plaintiff's Motion for Temporary Restraining Order and Preliminary Injunction (Doc. No. 7) only as to the request for a TRO. See generally Doc. No. 21. The Court stayed Plaintiff's request for preliminary injunctive relief until every Defendant had been served. The record reflects that Defendants Medlife Solutions, LLC, Growth Point Solutions LLC, P1 Medical Systems, LLC, and Jeff Davis have each been served. See Doc. Nos. 6, 12, 13 & 29. Further, Defendants Medlife Solutions, LLC, P1 Medical Systems, LLC, and Jeff Davis ("Defendants") have answered. See Doc. No. 23. Therefore, the Court enters this Order setting a briefing schedule for Plaintiff's request for preliminary injunction.
Plaintiff shall file a separate brief for preliminary injunction and any supporting materials by September 17, 2026.
Defendants shall file their response(s) and materials in support by October 8, 2026.
Plaintiff may file a reply brief by October 22, 2026.
The Parties shall follow all local civil rules and the undersigned's Judge Specific Requirements for filings.
It is within the Court's discretion whether to hold an evidentiary hearing on a motion for preliminary injunction. See, e.g., Fed. Sav. & Loan Ins. v. Dixon, 835 F.2d 554, 55859 (5th Cir. 1987); Heil Trailer Int'l Co. v. Kula, 542 F. App'x 329, 334 n. 17 (5th Cir. 2013)(per curiam); see also Fed. R. Civ. P. 43(c). The Court will set an evidentiary hearing only if one is necessary to resolve a controlling fact issue that involves a determination of witness credibility.
