TEXT ORDER: Pursuant to the Hearing held on 9/16/2026 and as specifically set forth on the record at that Hearing: (1) as to Letter Motion 383 , the Court once again sets a motion schedule, in that, (a) Defendants may file an appropriate motion by 9/30/2026, (b) Plaintiff shall respond by 10/14/2026, and (c) an In Person Hearing is scheduled for 10/22/2026 at 11:30 a.m., In Person, in Binghamton, New York; (2) The Court Re-Opens the Fact Discovery Phase and Depositions phase for the reasons set forth on the record; (3) (a) Defendants are authorized to file an Omnibus Discovery Motion by 10/2/2026, (b) Plaintiff shall file a Response by 10/16/2026, and (c) a Hearing is scheduled for 10/22/2026 at 11:30 a.m., In Person, in Binghamton, New York; (4) the Court finds good cause to Re-Open the Fact Discovery Phase and Depositions phase, as set forth at the Hearing and also for the following reasons, (a) Plaintiff has violated this Courts Discovery Orders multiple times including the ESI Order, Fact Discovery completion Order, and Orders to compel discovery, (b) Plaintiff has intentionally engaged in non-compliance with Court Orders, (c) Plaintiff and counsel for Plaintiff have engaged in misconduct in this litigation, including making false statements to the Court, and (d) Defendants have been substantially prejudiced during the Fact Discovery phase due to misconduct and violations by Plaintiff; (5) No later than 9/23/2026, the parties shall file detailed Status Reports advising the Court as to the four topics discussed at the Hearing, that being, (a) the Letter Motion 383 issues that the parties had allegedly resolved, (b) the deposition of Richard Agnello issue, (c) the deposition of Matthew Mroz issue, and (d) serving of subpoenas on LAM and serving deposition notices on LAM representatives; (6) the 9/29/2026 scheduled Hearing is cancelled; (7) The following deadlines which have not expired are STAYED and will be re-set in due course, (a) Defendants 9/29/2026 deadline for disclosure of Defendants Responding Party Expert Reports, (b) All Rebuttal Expert Report disclosure deadline, (c) deadline (10/30/2026) for completion of all Expert depositions, (d) the all Discovery deadline (10/30/2026), and (e) the 12/7/2026 Dispositive Motions filing deadline; (8) Letter Motions 415 & 422 requesting sealing are GRANTED pursuant to N.D.N.Y. Local Rule 5.3 and the Court finds that under the legal standard set forth in Lugosch v. Pyramid Co. of Onondaga Cty., 435 F.3d 110, 125-26 (2d Cir. 2006), such sealing is (1) essential to preserve values higher than a qualified First Amendment right of access to the material and (2) narrowly tailored to serve that interest; the Court finds that the parties possess a strong privacy interest in the information set forth in the filings; and (9) the clerk is directed to file under SEAL on the docket the following docket filings, 402 -27 (Ex. 26) affiliated with the Cardineau Opposition, 401 -4 (Ex. 2) and 401 -6 (Ex. 4) affiliated with the Privilege Log Opposition, 402 -2 (Ex. 1), 402 -3 (Ex. 2), 402 -4 (Ex. 3), 402 -5 (Ex. 4), 402 -6 (Ex. 5),

TEXT Minute Entry for proceedings held before Magistrate Judge Miroslav Lovric: an on the record Hearing was held on 9/16/2026, In Person, in Binghamton, New York. The Court addressed with the parties the issues and topics as raised by the parties in Status Reports 420 & 421 . The Court heard from all counsel regarding 420 & 421 . The Court also addressed with the parties, again, the issues raised in Defendants Letter Motion 383 . At the previous Hearing on 8/28/2026, the Court authorized Defendants to file by 9/11/2026 a motion concerning the issues set forth in Letter Motion 383 . See Text Order 392 . The Court did not receive such a motion filing by 9/11/2026. In their Status Reports at 420 & 421 , the parties advised the Court that on 9/3/2026 & 9/4/2026 Plaintiff and Defendants had mutually resolved and agreed in resolution of all issues raised in Defendants Letter Motion 383 and that therefore motion practice was unnecessary. At commencement of the hearing today, Defendants advised the Court that Plaintiff advised Defendants just before the start of todays hearing that Plaintiff no longer agreed to those agreements and resolution of the 383 issues. Therefore, the Court set a new schedule for motions concerning the Dkt. No. 383 issues and a new hearing date. The hearing previously scheduled for 9/29/2026 is cancelled. The Court STAYED various deadlines and schedules as set forth on the record and for the reasons set forth therein. The Court re-opened the Fact Discovery phase and depositions phase for the reasons set forth on the record. The Court set forth an Omnibus Motion filing schedule for the filing of discovery based motions by Defendants. A Hearing is scheduled for 10/22/2026 at 11:30 a.m., In Person, in Binghamton, New York.
