ELECTRONIC ORDER granting 36 Plaintiff's Motion for Referral to Mediation and Approval of Mediator. The Court has determined that this case is appropriate for mediation, to be completed no later than 01/08/2027. The parties have jointly selected and designate a mediator of their own choosing, Paul D. Stickney. The named parties must be present during the entire mediation process, and each party that is not a natural person must be represented by an executive officer (other than in-house counsel) with authority to negotiate a settlement, and the authority required shall be active, that is, not merely the authority to observe the mediation proceedings but the authority to negotiate, demand or offer, and bind the party represented. Counsel and the parties shall proceed in a good faith effort to try to resolve this case. The costs of mediation are to be divided and borne equally by the parties unless agreed otherwise, and the parties will make independent arrangements for the payment of fees directly to the mediator. No subpoenas, summons, citations, or other process shall be served at or near the location of any mediation session upon any person entering, leaving, or attending any mediation session. At the conclusion of the mediation, the mediator will complete and file the Alternative Dispute Resolution Summary Form (http://www.txnd.uscourts.gov/pdf/forms/adrsum.pdf) no later than 01/11/2027.
