ORDER. The Court is in receipt of the letter at ECF No. 52 . A Status Conference is set for 8/6/2026 at 12:30 PM before Chief Magistrate Judge Vera M. Scanlon via ZoomGov. To gain access to the ZoomGov audio conferencing system, the parties are to dial 1-646-828-7666; enter meeting ID 16121901090 and press the pound key; when asked for a participant ID, press the pound key; and enter passcode 091622 and press the pound key.
During the 7/21/2026 conference, Plaintiffs' counsel indicated that counsel intended to dismiss the action because the parties could not be properly identified. There was no discussion that Plaintiffs intended to proceed against the individual defendant.
Plaintiffs allege that they were employed by the corporate defendant and the individual defendant who worked for that entity. ECF No. 49 at 3. Plaintiffs now agree that they could not proceed against the corporate entity. It is unclear based on the last conference why Plaintiffs have a good faith basis to proceed against the individual defendant, although the Court entered a liability judgment against Defendants before the question of the correct identities had been raised by the corporate defendant.
