OPINION AND ORDER re: 99 MOTION to Dismiss Plaintiffs' Second Amended Complaint. filed by Anthony Giordano. For the foregoing reasons, Mr. Giordano's motion to dismiss is GRANTED IN PART and DENIED IN PART. The Court DISM ISSES Count I with prejudice. Counts II, III, and IV survive. Mr. Giordano shall file an answer to the SAC on or before October 13, 2026. On or before October 27, 2026, the parties shall submit to the Court a joint letter and proposed case managemen t plan in accordance with the specifications laid out in the Notice of Initial Pretrial Conference. (See Dkt. #4). If the parties wish to have a conference to discuss case management concerns, they may request so in their joint letter. Similarly, i f the parties wish to be referred to the designated Magistrate Judge or the Court's mediation program, they may make such a request.
