Stipulation and Order
STIPULATION TO AMEND CAPTION AND PLEADINGS: IT IS HEREBY FURTHER STIPULATED that the caption and any pleadings are hereby amended as shown below UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF NEW YORK ARACELIS LIRANZO and BENJAMIN LOPEZ Plaintiff(s), -against- FFE TRANSPORTATION SERVICES, INC., FROZEN FOOD EXPRESS and AARON PORTER, Defendant(s). IT IS HEREBY FURTHER STIPULATED that Plaintiff shall serve AARON PORTER with the applicable amended pleading and any other papers required by the Federal Rules of Civil Procedure. A facsimile copy of the signatures and of this stipulation can be considered the same as an original for the purposes of this stipulation. This stipulation may be filed without further notice with the Clerk of the Court. The Court is in receipt of the parties' proposed Stipulation to Amend Caption and Pleadings. (Dkt. No. 23 (the "Proposed Stipulation")). The Court endorses the Proposed Stipulation and ORDERS that by October 16, 2026, Plaintiffs shall serve the summons and complaint (Dkt. No. 1-1) on Porter and file proof of service. Further, the Court notes that Plaintiff Aracelis Liranzo has not responded to the counterclaim for indemnification (the "Counterclaim") asserted by Defendant FFE Transportation Services, Inc. ("FFE"). (Dkt. No. 8 at 10). By October 16, 2026, Liranzo shall respond to the Counterclaim. Liranzo is warned that failure to respond to the Counterclaim by October 16, 2026 may result in the Court permitting FFE to initiate default proceedings against Liranzo on the Counterclaim. The Court further directs the parties to its prior Order at Dkt. No. 22 that extends the fact discovery deadline to November 10, 2026 and reminds the parties that the next telephone conference to discuss the status of discovery is scheduled for October 28, 2026 at 11:00 a.m. ET. (Dkt. No. 22). The Clerk of Court is respectfully directed to replace John Doe with Aaron Porter ("Porter") as a defendant in this case. SO ORDERED. (Signed by Magistrate Judge Sarah L.
