Order on Motion to Substitute Attorney Scheduling Order
ORDER. In light of the ongoing settlement discussions, in consultation with the District Judge, to permit the parties sufficient time to investigate background facts, including the DOE pension-related information discussed on the record, the Court extends the District Judge's 7/30/2026 deadline by which the parties must submit an updated joint proposed briefing schedule, see 7/14/2026 Order, to 9/10/2026.
The parties are diligently working on settlement possibilities. A further settlement conference is scheduled for 8/27/2026 at 10:30 AM via ZoomGov. To gain access to the ZoomGov audio conferencing system, dial 1-646-828-7666; enter meeting ID 16121901090 and press the pound key. You will be asked for a participant ID. You do not have one, so simply press the pound key. Then, enter passcode 091622 and press the pound key again. Please note that your microphone will be automatically muted when you enter the virtual conference room. If another conference is underway, please remain on mute until the case is called. At that time, you may unmute your microphone by pressing *6 on your keypad.
Only counsel need attend this conference.
The motion to substitute attorney at ECF No. 41 is granted. Attorney Max Roseman is substituted as counsel for Plaintiff in place of formal counsel Andrew Zeitz.
