ORDER re 38 : Defendants move 38 to add new affirmative defenses against Plaintiff's claims of liability after discovery and dispositive motion practice has concluded. Under Rule 15's lenient standard, "absent undue delay, bad faith, dilatory tactics, and undue prejudice to the party to be served with the proposed pleading, or futility, [leave to amend] should be freely granted." Quaratino v. Tiffany & Co., 71 F.3d 58, 66 (2d Cir. 1995).
The Court understands that Plaintiff objects to the amendment of the answer, but Plaintiff has not yet provided the basis under the above-listed standard for the objection. The Court directs Plaintiff to issue a letter by 10/6/2026 detailing the legal basis for their objection. If Plaintiff fails to do so, the Court may consider the motion as unopposed.
