If Defendants choose to file another partial motion to dismiss, the Court expects that they will also file an answer as to the unchallenged counts. As there are at least four counts that will be allowed to proceed, this case is referred to the Magistrate Judge for discovery supervision, including the authority to set, adjust, and extend all deadlines, and to conduct a settlement conference if requested by the parties.
