TEXT ORDER: Plaintiff, who is representing himself, moved to withdraw from this case, which the court interpreted as a motion for voluntary dismissal of his claims, Fed. R. Civ. P. 41(a), and entered judgment accordingly. Doc. no. 84. Plaintiff moved to reinstate his claims, explaining that he did not intend to dismiss his claims, and the court granted that motion in part, reinstating the case. Doc. no. 97. In the meantime, plaintiff also appealed from the judgment previously entered. Doc. no. 88. Recently, the Magistrate Judge denied plaintiff's motion to proceed in forma pauperis on appeal because his case here had been reinstated. Text Or. July 30, 2026. Plaintiff objects to that decision on the ground that reinstatement did not make his appeal moot. Doc. no. 132. Because of the reinstatement, the First Circuit Court of Appeals directed plaintiff to show cause why his appeal was not moot and has not yet resolved that question. In the event the Court of Appeals determines that the appeal is not moot and proceeds, plaintiff may move for in forma pauperis status. Plaintiff's objection (doc. no. 132) is denied.
