ORDER: Plaintiff filed the complaint on 5/27/2026 and the Clerk issued summons for defendant Outside In on 6/2/2026. To date, no waiver or proof of service of the summons and complaint have been filed and defendant has not appeared. Under FRCP 4(m), if the defendant is not served within 90 days after the complaint is filed, the court must dismiss the action without prejudice or order that service be made within a specified time. If a plaintiff shows good cause for the failure, the court must extend the time service. Local Rule 41-2 also allows the court to "notice for hearing" any action that "does not appear to be diligently prosecuted." Accordingly, plaintiff is ORDERED to file proof of service on defendant or file a written statement by September 9, 2026, describing the status of this action and whether good cause exists to dismiss for failing to timely serve defendants and the resulting lack of prosecution. Failure to timely comply with this Order will result in dismissal of this action without prejudice. Ordered by Magistrate Judge Jeff Armistead. (ecp)
