Text Order ~Util - Terminate Motions
TEXT ORDER -- The Court is in receipt of Plaintiffs' "Emergent Motion for Relief and Temporary Stay of Foreclosure Sale." ECF No. 170. Plaintiffs ask the Court to "[i]ssue an immediate temporary restraining order and preliminary injunction staying any and all foreclosure proceedings" and to "[v]acate and set aside the Foreclosure Judgment entered [in state court] on February 15, 2023." Id. at 11. The Court denied Plaintiffs' request for similar relief in its Order dated October 29, 2021, and again recently in a parallel proceeding before this Court. See ECF No. 139; Perez v. J.P. Morgan Chase Bank, No. 22-4173 (CCC)(JBC) (D.N.J. filed June 21, 2022) at ECF No. 93 (Issued April 15, 2026). The motion (ECF No. 170) is DENIED for the reasons set forth in the Court's prior Orders. Namely, the Anti-Injunction Act prohibits the Court from issuing an injunction staying state court proceedings. ECF No. 139 7-9; No. 22-4173, ECF No. 93 at 3-4. So Ordered by Judge Claire C.
