PAPERLESS ORDER denying without prejudice Defendant's request for discovery hearing (DE 45 / 47 ). By 8/25/2026, Defendant shall file an appropriate discovery motion regarding the issue raised in DE 45 . By 8/27/2026, Plaintiff shall file a response. The motion and response shall not exceed 5 double-spaced pages. No reply may be filed absent further order. After reviewing the motion and response, the Court will rule on the papers, set a hearing, or issue further instructions.
Additionally, by 8/26/2026, Defendant's counsel shall file a written response to show cause why sanctions should not be imposed against Defendant's counsel under Rule 16(f) and/or the Court's inherent powers. Once again, Defendant's counsel has violated 20 Discovery Procedures Order ("DPO") by filing a notice of discovery dispute that improperly includes argument and other content that is not permitted under the DPO. The Court has previously warned Defendant's counsel that further noncompliance with the DPO may result in the imposition of sanctions (DE 33). Signed by Magistrate Judge Jared M.
