Order on Motion for Miscellaneous Relief
TEXT ORDER-- The Court has reviewed Plaintiff's September 9, 2026 letter seeking a conference to request leave to file an amended complaint. (ECF No. 22 ). The Court notes that Defendants' motion to dismiss filed on August 10, 2026 is pending and unopposed at this juncture. (ECF No. 9 ). Plaintiff's request for a conference is DENIED. Rather, as the time to amend the complaint as of right in response to the motion to dismiss has expired under Rule 15(a)(1)(B), Plaintiff is DIRECTED to follow the protocol set forth in the undersigned's Judicial Preferences, the Federal Rules, and the Local Rules for seeking an amendment. Namely, Plaintiff must first provide a draft of the proposed amended pleading to all current parties to ascertain if they will consent to the amendment. Plaintiff is DIRECTED to accomplish this by September 18, 2026. If Defendants consent, Plaintiff may file the amended complaint on consent, with a redlined copy showing all changes annexed to a separately-filed letter indicating that there is consent, by September 18, 2026. If Defendants do not consent, then Plaintiff is granted leave to file a motion to amend, attaching a clean copy and a redlined copy of the proposed amended pleading, by September 25, 2026. Defendants are reminded that motions to amend are liberally granted at this early stage in the case, and that the Court will generally not deny an amendment based upon futility grounds, so Defendants are encouraged to avoid unreasonably withholding their consent and engaging in unnecessary motion practice. The filing of an amended complaint would be without prejudice to Defendants' right to file a renewed motion to dismiss, if appropriate, in response the amended complaint.
