TEXT ORDER: This matter comes before the Court upon a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 ("Petition"). (ECF No. 1 .) The Court has reviewed the Petition (ECF No. 1), and the Response (ECF No. 4 ). According to the Response, Petitioner is detained pursuant to 8 U.S.C. § 1226(a). To the extent Petitioner challenges the lawfulness of his detention under 8 U.S.C. § 1226(a), the Court notes that a noncitizen detained pursuant to § 1226(a) may request a bond hearing before an Immigration Judge pursuant to 8 C.F.R. §§ 236.1(d)(1) and 1236.1(d)(1). See Jennings v. Rodriguez, 583 U.S. 281, 306 (2018). The record indicates that Petitioner has requested and received a bond hearing. Because Petitioner is lawfully detained pursuant to § 1226(a), the Court's September 16, 2026 Order (ECF No. 2 ) is VACATED. The Petition is DISMISSED WITHOUT PREJUDICE to Petitioner's ability to reopen this matter should he otherwise seek judicial review of the legality of his continued detention. So Ordered by Zahid N.
