REPORT AND RECOMMENDATION TO THE HON. VERNON S. BRODERICK re: 130 FIRST MOTION to Vacate default and dismiss. FIRST MOTION to Dismiss for Lack of Jurisdiction . filed by Emily Fisher. For the reasons set forth above, the branch of Fisher's cross-motion seeking to vacate the entry of default against her (Dkt. 130) is hereby GRANTED, and the certificate of default (Dkt. 119)is hereby VACATED. In addition, I hereby RECOMMEND, respectfully, that plaintiff's motion for a default judgment (Dkts. 121, 123) be DENIED as moot; that the branch of Fisher's cross-motion seeking to dismiss plaintiff's claims pursuant to Rule 12(b)(5) be GRANTED, and that all of plaintiff's claims against Fisher be DISMISSED WITHOUT PREJUDICE.
