MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 7/10/2026. By Law Clerk: S. Gorba.
Pending before the Court is the Stipulated Protective Order Governing Confidential Information (ECF No. 13 ). The provisions of the proposed stipulated order regarding protection are generally approved; provided, however that the parties are reminded that the Federal Rules of Evidence and Civil Procedure apply in federal court. As such Fed. R. Evid. 502, and case law interpreting the same, governs resolution disputes pertaining to the inadvertent disclosure of attorney work product and attorney client privileged communications. Further, the stipulation contemplates that documents marked as confidential under the agreement can be file dunder seal. This too is incorrect. A protective order is, as a matter of law, insufficient to justify sealing documents. Heath v. Tristar Products, Inc., Case No. 2:17-cv-02869-GMN-PAL, 2019 WL 12311995, at *1 (D. Nev. Apr. 17, 2019) citing Foltz v. State Farm Mut. Auto. Ins. Co., 331 F.3d 1122, 1133 (9th Cir. 2003). The parties must, instead, file a motion to seal citing relevant federal case law and the applicable standard concomitantly with the documents under seal, and redacted versions of such document on the publicly available docket.
Accordingly, IT IS HEREBY ORDERED that the Stipulated Protective Order Governing Confidential Information (ECF No. 13 ) is GRANTED as modified by this Order.
