ORDER - This matter is scheduled for an in-person settlement conference on June 29, 2026. (ECF No. 72 .) Having received a joint request from the parties, through counsel, to permit Plaintiff and Defendants business representative to attend the settlement conference virtually, the Court grants this request. Counsel is ORDERED to attend the settlement conference in-person and make appropriate arrangements for their respective clients to appear both by video and audio means. Those appearing virtually must be stationed at a private, non-transient location for the duration of the settlement conference. Pursuant to Local Civil Rules 83.3(C) and 83.6(E), the confidential nature of settlement discussions must be protected. Therefore, third-party participation and any recording of the settlement conference are prohibited. See E.D. Va. Loc. Civ. R. 83.6(E) (The substance of communication in the mediation process shall not be disclosed to any person other than participants in the mediation process."); E.D. Va. Loc. Civ. R. 83.3(C) ("Any person remotely participating in any court proceeding may not record or cause to be recorded any such proceeding without express consent of the presiding judge.") It is so ORDERED.
