Stipulation and Order of Voluntary Dismissal
STIPULATION OF DISCONTINUANCE: The plaintiff and defendant, by and through the undersigned, herein stipulate that the above-entitled action shall be dismissed with prejudice to plaintiff on his Complaint and without costs and/or attorney's fees to any party. Federal Rule of Civil Procedure 41 (a)(2) governs a plaintiff's voluntary dismissal of the complaint after an answer has been filed. See Fed. R. Civ. P. 41(a)(2) (permitting volunta1y dismissal "only by court order, on terms that the court considers proper"). Here, the parties stipulate to dismissal with prejudice, and the Court agrees that such dismissal is appropriate. Accordingly, the action is DISMISSED with prejudice.
