Order on Motion for Extension of Time to Complete Discovery
ENDORSED ORDER granting in part and denying in part 33 Defendant AndorHealth, LLC's Unopposed Corrected Second Motion to Extend Discovery and Mediation Deadlines and Incorporated Memorandum of Law. To the extent that Defendant's motion is premised on its pending motion to dismiss, filed on September 9, 2026, the motion is not well taken. For one, the pendency of a dispositive motion does not ordinarily justify a stay of discovery. Middle District Discovery (2021) § (I)(E)(4). For another, given that the motion to dismiss was just filed yesterday, it is unlikely that the motion will be resolved during the requested 30-day extension in any event. However, given Defendant's representations regarding CM/ECF access, and Plaintiff's lack of opposition, the Court finds good cause for a limited extension of the discovery period for purposes of conducting the depositions outlined in the motion. The Court also will permit the limited extension of the mediation deadline. Accordingly, it is ORDERED that the discovery deadline is extended up to and including September 28, 2026 for the sole and limited purpose of completing the depositions outlined in the motion. The Court will not entertain any discovery motions unrelated to these depositions, and the discovery period is otherwise closed. The mediation deadline is extended up to and including October 13, 2026. The parties shall file a notice setting forth the date, time, and location of their mediation within seven (7) days of this Order. No other deadlines, including the September 29, 2026 dispositive motions deadline and March 2027 trial, are extended by this Order. Nor may the parties rely upon this Order to support a request for any further extensions of case management deadlines. These deadlines will not be further extended absent truly exigent circumstances.
