ORDER re 37 -- The Court is in receipt of the Delicias Calenas Defendants' letter noting that Defendants had settled the case for $17,500 after a successful mediation hearing, but that Defendants are unable to remit payment as a lump sum. See, Dkt. Entry No. 37 . The parties are directed to request a settlement conference before the Hon. Peggy Kuo, U.S.M.J to further discuss settlement. The parties are advised to engage in such discussions in good faith and in a cooperative manner. Briefing on Plaintiff's motion to enforce settlement is stayed pending the conference.
The parties are reminded that, as a matter of public policy and as required under the FLSA, the Court must review all FLSA settlements to ensure a fair and just result for plaintiff workers. See, Cheeks v. Freeport Pancake House, Inc., 796 F.3d 199 (2d Cir. 2015). The parties are on notice that they may not, in any way, distribute the proceeds from any settlement or execute the terms of any settlement until it has been reviewed by the magistrate judge and approved by the magistrate judge and the undersigned district judge. For FLSA settlement approval, the parties are reminded that they may consent to the jurisdiction of the Magistrate Judge to conduct all remaining proceedings. See, Fed. R. Civ. P. 73 and L. Civ.
