   ORDER adopting in part and modifying in part 54 Report and Recommendation. The Defendants' objections to the R&R (Doc. 56) are SUSTAINED IN PART and OVERRULED IN PART. Captain Braithwaite's motion for judgment on the pleadings (Doc. 39 ) is GRANTED IN PART and STAYED IN PART pending supplemental briefing. The City's motion for judgment on the pleadings (Doc. 40 ) is GRANTED IN PART and DENIED IN PART. Major Mechler's motion for judgment on the pleadings (Doc. 41 ) is GRANTED. Director Robison's motion for judgment on the pleadings (Doc. 42 ) is GRANTED IN PART and STAYED IN PART pending supplemental briefing. In addition, the Court DIRECTS Captain Braithwaite to submit a supplemental brief addressing whether he is entitled to qualified immunity on Plaintiff's Section 1981 hostile work environment claim (Count IV). The Court further DIRECTS Director Robison to submit a supplemental brief addressing whether he is entitled to qualified immunity on Plaintiff's Section 1981 intentional discrimination, hostile work environment, and retaliation claims (Counts III, IV, and VIII). Defendants' respective supplemental briefs are due by August 27, 2026. Plaintiff shall submit his response to each supplemental brief within 14 days of Defendants filing their respective briefs.
