Status Report Order 1 - Terminate Deadlines and Hearings
SCHEDULING ORDER: The initial conference in this action is converted to a default conference scheduled for 7/7/2026 at 11:00 AM before Chief Magistrate Judge Vera M. Scanlon; the CMP deadline is adjourned. To gain access to the ZoomGov audio conferencing system, counsel and/or any pro se parties are to dial 1-646-828-7666; enter meeting ID 16121901090 and press the pound key; when asked for a participant ID, press the pound key; and enter passcode 091622 and press the pound key. Although Defendant Van Blarcom Closures, Inc. has not yet appeared in this case, it may appear at the conference. The parties should expect to discuss the Plaintiffs' anticipated request for an entry of default. Plaintiffs should refrain from filing further requests for certificates of default prior to the conference. Certificates of default will not be issued at this time.
Plaintiff has represented that Defendant Van Blarcom Closures, Inc. has been served with the complaint, which is the document that states Plaintiffs' claims against Defendant. See ECF No. 1 . Plaintiffs seek, inter alia, relief for alleged breach of ERISA and contract obligations. Because Defendant Van Blarcom Closures, Inc. has not responded to this lawsuit by answering the complaint or moving to dismiss it, the Court may award damages against Defendant Van Blarcom Closures, Inc. and in favor of Plaintiffs should default be entered and should Plaintiffs move for a default judgment, for which Defendant Van Blarcom Closures, Inc. would be liable. If Defendant Van Blarcom Closures, Inc. does not participate in the lawsuit now, it would likely waive the right to raise factual or legal defenses that it may have to Plaintiffs' claims.
By 6/15/2026, Plaintiffs must file personal proof of service of this Order, the complaint and the docket sheet upon Defendant Van Blarcom Closures, Inc at their business address: 156 Sandford Street, Brooklyn, NY 11205.
