TEXT ORDER: On June 1, 2026, Defendant Timothy L. Killen 45 asked the Court to "deem admitted" a set of sixty-three interrogatories on the ground that Plaintiff never responded to them. Defendant Killen also asked the Court to accelerate the briefing schedule on his 45 motion, explaining that his 46 motion for summary judgment relies on those same interrogatories. Under Civil Local Rule 7.1(B)(2), Plaintiff's response to the 45 motion was due by June 15, 2026. To date, Plaintiff has not responded. Accordingly, Plaintiff is ORDERED to file a response by July 2, 2026, indicating whether--and, if so, on what grounds--he opposes Defendant Killen's 45 motion to deem interrogatories admitted. Should Plaintiff fail to respond, the Court will presume the motion is unopposed and rule without further notice. See Civil LR 7.1(B)(2). Entered by Magistrate Judge Ronald L. Hanna on June 25, 2026.
