TEXT ORDER: The Court has reviewed Respondents' Answer (ECF No. 5), which concedes that Petitioner's detention is based upon an interpretation of 8 U.S.C. § 1225(b) that this Court has previously rejected. However, the pro se Petition (ECF No. 1) does not appear to seek release or a custody redetermination, but instead requests injunctive relief prohibiting Petitioner's transfer to another detention facility. Accordingly, IT IS on this 7th day of July 2026, ORDERED that, within 7 days of the entry of this Text Order, the parties shall submit supplemental briefs addressing whether the Petition should be construed as challenging the statutory basis for Petitioner's detention and, if so, whether the Court has authority under 28 U.S.C. § 2241 to grant relief beyond that expressly requested in the Petition. The parties shall also address whether the relief expressly sought in the Petition falls within the scope of relief available under 28 U.S.C. § 2241. It is FURTHER ORDERED that the Court construes Petitioner's Reply (ECF No. 6) as a Motion to Consolidate this matter with Laiton-Guerrero v. Rokosky et al., Civ. No. 26-07591, which concerns the same underlying immigration detention. For good cause shown, the motion is GRANTED, and the Clerk shall consolidate these matters. So Ordered by Judge Jamel K.
